EZGO飛凰國際物流使用者條款
1. 適用範圍
1.1 本條款適用於所有使用EZGO飛凰國際物流(以下簡稱「EZGO」)服務的託運者。
1.2 通過訪問或使用EZGO平台及其提供的各項服務,您(以下簡稱「託運者」或「您」)即表示同意並接受本條款的全部內容。請您務必詳細閱讀,以確保完全理解EZGO的權利與義務。
2. 基本條款
2.1 託運者必須承擔包裹到達EZGO倉庫運輸途中之任何損失或損壞之風險。
2.2 專線取件服務必須符合以下條款:
2.2.1 當EZGO司機到達時,您的包裹必須準備就緒,每次取件將不超過10分鐘的等待時間。如司機必須再次提相同的貨物,將會收取每次USD$10的手續費用。
2.2.2 取件服務時間將因交通狀況或任何其他道路情況而異,在EZGO確認接送時間後,託運方不得催促時間或與駕駛員指定到達時間。
2.3 EZGO集運代收服務是由貨物抵達倉庫並由EZGO簽收後開始。
2.4 EZGO有權在不事先通知託運方的情況下,根據安全、保護、海關或其他管制要求對貨件進行開箱抽驗、整併和分拆。
2.5 EZGO提供之服務不負責一切關於商品相關瑕疵(貨物少發、漏發、商品品質問題等)及侵害知識產權等責任。
2.6 認知國際運輸存在風險,貨件在運送過程中(包括海關檢查)造成損壞時,除非加購保價服務,否則無法理賠。
2.7 配送至EZGO提供倉庫的包裹,如超過D+90日倉儲時間(包裹到倉當日為D日),EZGO有權銷毀該包裹。
3. 申報及禁運相關
3.1 託運者需如實申報所有託運物品的名稱、價值等信息。若因申報不實而導致法律責任,託運者應負全部責任,並賠償EZGO因此產生的任何損失。
3.2 禁止託運貨物例示名單如下,詳細說明可參本公司網站公布之禁運用品名單,本公司保留解釋及隨時修改禁止託運貨物名單之權利。
3.2.1 被IATA、ICAO、ADR或相關政府及組織歸類為危險物、違禁品的物品。
3.2.2 法令禁止或限制運送、進出口的物品。
3.2.3 禁運物品包括但不限於:
- 爆炸性、易燃性、腐蝕性、毒性及放射性等危險物品
- 毒品及吸毒器具
- 不雅或違反風俗文化的物品
- 偽造商標或侵犯著作權的物品
- 貨幣、珠寶、有價證券、信用卡及票券
- 易腐物品、活動物及植物
- 藝術品
- 其他出口地或中華民國法令限制的物品
3.3 EZGO保留是否受理委託之權利
3.3.1 EZGO保留開封檢查商品的權利,但並無檢驗商品的義務,且檢驗結果不對商品的品質、瑕疵、真假作出任何保證,也不保證商品符合發貨地、經由地及目的地的相關法規。
3.3.2 如EZGO在檢驗過程中懷疑商品可能違反法律規定,得通知警察、海關或相關執法機關,並可提交商品等證據。
3.3.3 如因檢驗或依本條款採取措施而造成損失,EZGO不承擔任何責任。
3.3.4 若EZGO在檢查中發現禁止運送的物品,將立即停止服務,並有權棄置或依其他適當方式處置。
4. 商品價值保險、逾期及賠償相關
4.1 若託運物之單價超過$1000美元,託運者應事先告知EZGO,並應自行投保貨物保險,貨物保險之保險費用由託運者自行承擔。
4.2 EZGO受託代辦之運送服務為國際海運或空運,為維護運送物之安全,原箱出貨商品託運者就其所託運之物品應自行要求供貨商妥善包裝,以避免於運送過程中發生毀損、滅失及其他損害。因貨物包裝不固所導致之毀損、滅失,應由託運者自行承擔貨損相關責任。家具類、美妝品、液體及易碎品部分等極度易損壞物品,若填寫運單時有勾選加值服務操作,運送過程若不幸損壞,應由託運者自行承擔貨損相關責任,EZGO一律不予賠償。
4.3 賠償規定:
4.3.1 託運者受領託運物品時如發現貨物有異狀,應於託運憑單或簽收單據簽註保留意見,並於開拆貨物時錄影及拍照存證,作為求償之依據。
4.3.2 如託運者未簽註保留意見,視為託運者受領之貨物完好無缺,不得提出求償。
4.3.3 若託運物品之毀損、滅失係可歸責於EZGO時,EZGO所負之賠償責任,按託運者填寫之物品價值或實重每磅10美元計算,二者取其較低者為賠償標準,又每一運送提單(CWB)最高賠償金額為100美元。
4.3.4 EZGO之責任完全只限定於直接損失、損害,不包括所有其他類型之損失或損害(如失去的利潤、收入、利益及未來生意等)
4.4 索賠期限:
4.4.1 所有索賠案應從接受貨物日起七天內以書面向EZGO提出,否則EZGO將不負任何責任。
4.5 不理賠事項:
4.5.1 天然災害所造成的破損或貨件遺失,不在EZGO承擔的範圍內,將不獲得任何賠償:
- 運輸途中由於氣候惡劣、雷電、地震、洪水等自然災害所造成的遺失或毀損。
- 任何由於溫度、濕度變化而導致的毀損
- 大自然所造成,如地震、龍捲風、颶風、洪水、水災、大霧、大雪、霜凍天氣或地質災害等不可控因素。
4.5.2 未購買保價服務的情況下,貨件運送過程中造成的損壞無法理賠。
4.5.3 託運者無法提供證據證明在產品抵台前已損壞的情況下,EZGO無法受理理賠。
4.5.4 以下情況所造成的破損不在EZGO提供之服務承擔的範圍內,將不獲得任何賠償:
- 含液體、危險品及禁運物品
- 易碎、沒有合適保護及容易破損的物品(如: 陶瓷製品、玻璃製品、塑膠製品、書籍、紙類製品、電子產品、CD&DVD、化妝品類(如眼影盤、口紅)、廢品、瑕疵品等)
- 貨品本身包裝不當,沒有提供適當保護
- 原封包裝完好的貨品
- 包裝變形、折損等,但裡面商品是完好的
- 非紙箱或木箱包裝、非密封包裝貨件
- 食品
4.5.5 其他無法預期及不可抗力之因素所造成的破損或貨件遺失,不在EZGO提供之服務承擔的範圍內,將不獲得任何賠償:
- 任何海關、運輸公司、機場及政府當局所導致的情況,如海關退運、航班延誤、底片曝光、音帶消除等
- 沒有申報、虛報、刻意隱瞞或無法提供包裹追蹤碼的貨件
- 提供錯誤的收貨標識、錯誤的預報信息,無入庫記錄,或網站錯發,漏發等
- 沒有任何簽收或快遞證明已派送至海外倉庫的貨件
- 收件地址填寫錯誤或未準確按照EZGO規定指示操作之情況
- 提供錯誤、不完整、不正確或遺漏的地址信息,無法聯繫收件人,造成的重複配送所產生的費用及相關後果
- 因清關時效而導致的過保質期、過保修期等
- 任何地區性糾紛,如入侵、暴動、罷工、騷亂、內亂、戰爭等
- 任何國家實施的臨時禁運措施
- 任何災害(如:火災、水災等)或是運輸途中因意外、失事、車禍等
- 因天氣因素(如:雨)造成包裹淋濕、破損、損壞。
5. 國際公約
5.1 貨物如係以空運運送至出發國以外國家為終點站或停留站時,如適用蒙特利公約、或華沙公約,應依其規定辦理。
5.2 如係國際公路運輸,則得適用國際公路貨運公約 (CMR) 。這些公約均限定EZGO之損失或損害賠償責任。
6. 貨物運費
6.1 EZGO之貨物運費是根據實際包裹重量或材積重量二者之間較重者計算之,同時任何貨物得由EZGO重新過磅與測量,以確認該計算值是否正確。託運人應支付或償還EZGO因其提供服務、或代表託運人或收件人或任何第三者所產生之所有貨物運費、相關附屬之費用、代墊之關稅與稅款。
6.2 若運費因出口或進口國海關查扣而無法送達,不予退費。
7. 不可抗力因素
7.1 因不可抗力因素導致的情況,EZGO不對運輸延誤或其他問題承擔責任。不可抗力包括但不限於以下情形:
- 自然因素:如地震、龍捲風、風暴、洪水、火災、瘟疫、霧、雪、霜凍天氣或其他地質災害等。
- 人力不可抗因素:如空難事故、公敵入侵、政府當局行為、法律規定、暴動、罷工或其他區域性爭端、群眾騷亂或戰爭等。
- 其他非EZGO可控的因素:如國家或區域性空中或地面交通系統的中斷,通訊系統干擾或故障,運輸工具或機器的機械故障等。
- 第三方失誤:如因海關、航空公司、機場或政府部門所產生的疏失,包括海關退運、航班延誤、貨物瑕疵、內容物不完整,或數據、照片、影像等存儲媒體資料的丟失或損毀。
7.2 EZGO會在無法控制的情況下,仍盡力協調物流公司以最快速度將貨物運送至目的地,然而,EZGO無義務在此類情況下向您另行通知。EZGO亦不對延誤運輸承擔責任,即使根據其標準程序已盡最大努力協調派送,這些標準不構成任何承諾或服務協議的一部分。
8. 免責聲明
8.1 本公司對網站內容不提供任何保證,網站所提供的功能不承諾能滿足會員的所有需求。
8.2 本公司及網站不對任何直接、間接、偶然、特殊或連帶損失負責,這些損失可能來自不當使用、非法操作或駭客攻擊。
8.3 針對因政府禁令、適用法律或法規變更、動亂、戰爭、停電、通訊中斷等不可抗力事件或他人蓄意破壞造成的服務中斷及其相關損失,本公司不承擔任何責任。
8.4 因承運人未履行責任或疏忽導致的貨物損失,本公司不負責。
8.5 由於客戶下單時未正確填寫會員號碼或倉庫收貨信息,導致包裹延誤派送、入錯庫或未能送達倉庫,相關責任由客戶自行承擔。
8.6 當地快遞顯示包裹已於有效時間內送達倉庫,但實際未收到的情況下,請與我們聯繫並提供正確的貨物追蹤編號及簽收證明。本公司會於1至2個工作日內回覆。雖然EZGO會盡力協調物流公司快速運送至目的地,但對於無法控制的情況,本公司無義務向您發出通知。
8.7 因客戶違反本公司、航空、船運公司及海關的相關規定(如申報不實、運輸違禁物品或超過海關限額)而導致的貨物遺失、清關延誤、罰款或退運,相關責任由客戶承擔。
8.8 如包裹中含有申報明細中未列明之物品,且該物品發生遺失,相關責任由客戶承擔。
8.9 正常入庫後,如客戶超過當地倉庫規定天數未提交發貨申請,則視為放棄貨物,貨物可被銷毀,本公司不負責繼續保管或對任何損失承擔責任。
8.10 如客戶未申請驗貨或核對服務,本公司不承擔發貨方少發、錯發、貨物瑕疵或缺陷導致的損失。客戶收到貨物後,如有貨品與訂單不符,損失應由客戶自行承擔或向發貨方求償。
8.11 所有貨物到達後均依本公司作業規則處理,集運合併方式由本公司最終決定。若需保留原包裝,並因理貨後增加收費重量,相關費用由客戶自行承擔,且無法取消或要求重新包裝。
8.12 因不可抗力(包括但不限於颱風、地震、洪水、火災、戰爭、罷工、政府行為、政策變更等)導致貨物運輸延誤、終止,或貨物在途中因機場、碼頭海關置放打濕、變形、凍結或損壞,本公司不負賠償責任。國內快遞不接受賠償申請,客戶需自行做好防水、防雨措施。
8.13 如品名、品項未確實申報,或運單填寫不完整,導致線路選擇不符,本公司不負責賠償。
8.14 當海關查驗包裹並要求重新申報時,客戶需簽署《代理報關委託書》。簽署委託書代表客戶同意並遵守所有報關規範,並負責支付額外報關費用及滯報金、罰款等。如客戶拒簽委託書,本公司有權凍結客戶賬號、終止服務,且不承擔任何責任。
8.15 國際包裹自寄出次日起算30天,倉庫代收包裹自入庫次日起算90天,逾期不予追蹤查詢,亦不負補償責任。
9. 託運人之保證與賠償
9.1 託運人因不遵守任何有關法律或法規,以及違反以下保證與表示時,託運人應賠償EZGO並使EZGO免受任何損失或損害:
- 由託運人或其代表人所提供之所有資料是完整與正確的。
- 貨物是由託運人員工在安全的前提下所準備的。
- 託運人僱用可靠的員工來準備貨物。
- 在準備、儲存與運送至EZGO當中,託運人防止貨物受到未經許可之干擾。
- 貨物業經適當地標示、載明地址及包裝,以確保在一般處理狀況下能安全的運送。
- 符合所有相關海關、進口、出口與其他法律與法規規定。
- 提單業經託運人之被授權代表人簽署,本條件與條款對託運人即具有約束力與強制力。
10. 運送貨物路線
10.1 託運人同意所有運送貨物路線與改變運送路線,包括貨物可經由中途站轉送,悉由EZGO自行決定。
11. 拒絕承攬
11.1 本公司保留依據業務需求、風險評估及相關法律規定,拒絕承攬以下類型貨物或服務的權利,且無須就此決定向客戶作出進一步說明或承擔任何責任:
- 違禁品及受限物品:包括但不限於國際、國內法律明文禁止或限制運輸的物品,如毒品、爆炸物、武器、危險化學品、受保護的野生動植物及其製品等。
- 不當申報或虛報內容:如客戶故意不實申報貨物品名、數量、價值或性質,或隱瞞實際貨物性質。無法提供購買收據付款證明。
- 未按規定包裝:貨物包裝不符合運輸安全標準,易碎、易損或不適當包裝可能對運輸過程中造成危害或損壞的物品。
- 高風險貨物:如貴重金屬、現金、有價證券、珠寶、藝術品等高價值或難以估價的物品。
- 法律或政策禁止運輸的貨物:因地區性法律、政策或海關規定臨時禁止運輸的物品,或無法取得相關運輸及清關許可等文件的貨物。
- 易腐、易壞或需特殊運輸條件的貨物:包括需要冷藏、冷凍或其他特殊環境下運輸的食品、藥品等,若客戶未能提供符合規定的運輸條件,本公司有權拒絕承攬。
- 其他無法預見的風險:因美國及台灣或所在國家法律變更、關稅政策調整或其他不可控因素(如罷工、天災、人為干擾等)導致的潛在風險貨物,本公司保留拒絕承攬的權利。
- 任何可能對本公司、第三方或公共安全造成風險的貨物:包括但不限於潛在安全威脅、污染或對環境有重大影響的貨物。
12. 準據法及管轄法院
12.1 為保障EZGO之權益,因本條款所引起或與之相關的任何爭議、糾紛或索賠(包括但不限於合約履行、違約、侵權等),均應依照貨物運送起始國之法律作為準據法進行解釋與適用。
12.2 任何因本條款所產生之爭議,應提交貨物運送起始國之非專屬管轄法院進行裁決。託運人明確同意並接受該管轄權,且不得以任何理由提出異議,除非相關法律另有強制性規定。
12.3 若任何爭議涉及多國法律或國際公約,EZGO有權選擇適用對其最有利之法律或公約,並保留最終解釋權。
13. 可分割性
13.1 若本條款中任何條文被具有管轄權之法院或仲裁機構判定為無效、不合法或不可執行,該條文之無效性、不合法性或不可執行性不影響本條款其他部分之有效性及可執行性。
13.2 本條款之其他部分仍應保持完全效力,並繼續對雙方具有約束力。若任何條文被判定為無效或不可執行,雙方應以最接近原條文意圖之有效且可執行之條文取代,以確保本條款之整體效力不受影響。
13.3 EZGO保留對本條款之最終解釋權及修改權,並有權根據實際情況調整條款內容,以確保其合法性及可執行性。
- Scope of Application
1.1 These Terms and Conditions apply to all shippers using the services provided by EZGO Feihuang International Logistics (hereinafter referred to as "EZGO").
1.2 By accessing or using EZGO's platform and services, you (hereinafter referred to as "the Shipper" or "you") acknowledge that you have read, understood, and agreed to these Terms and Conditions in full. Please ensure you read them carefully to understand your rights and obligations under EZGO's services.
- Basic Terms
2.1 The Shipper assumes all risks of loss or damage to packages during transit to EZGO's warehouse.
2.2 The direct pickup service must comply with the following conditions:
2.2.1 Packages must be ready when the EZGO driver arrives. The waiting time for each pickup will not exceed 10 minutes. A fee of USD $10 will be charged for each additional pickup attempt for the same items.
2.2.2 Pickup times may vary due to traffic or road conditions. Once the pickup time is confirmed by EZGO, the Shipper may not request changes to the schedule or specify a delivery time with the driver.
2.3 EZGO’s consolidation and collection service begins when goods arrive at the warehouse and are signed for by EZGO.
2.4 EZGO reserves the right to open, inspect, consolidate, or separate shipments based on security, safety, customs, or regulatory requirements without prior notice to the Shipper.
2.5 EZGO does not take responsibility for product defects (e.g., shortages, omissions, quality issues) or intellectual property rights violations.
2.6 Acknowledging the risks of international shipping, damage during transit (including customs inspections) will not be compensated unless the Shipper purchases insurance coverage. 2.7 Packages stored at EZGO’s warehouse for more than 90 days (D+90, with the arrival date being Day 1) may be destroyed by EZGO without prior notice.
- Declaration and Prohibited Items
3.1 The Shipper must truthfully declare all item descriptions and values. The Shipper assumes full liability for any legal consequences due to false declarations and must compensate EZGO for any resulting damages.
3.2 Prohibited items are as listed on the EZGO website. EZGO reserves the right to interpret and modify the list at any time. Prohibited items include, but are not limited to:
3.2.1 Dangerous or restricted goods as classified by IATA, ICAO, ADR, or any relevant government bodies or organizations.
3.2.2 Items prohibited or restricted for transport, import, or export by law.
3.2.3 Prohibited items include but are not limited to:
- Explosive, flammable, corrosive, toxic, or radioactive materials
- Drugs and drug paraphernalia
- Obscene or culturally offensive items
- Counterfeit or copyright-infringing goods
- Currency, jewelry, securities, credit cards, and vouchers
- Perishable goods, live animals, and plants
- Artworks
- Any items restricted by the laws of the origin or destination country 3.3 EZGO reserves the right to accept or reject shipments at its discretion. 3.3.1 EZGO reserves the right to inspect items but is under no obligation to do so. EZGO makes no guarantees regarding the quality, authenticity, or compliance of goods with the regulations of the shipping, transit, or destination countries. 3.3.2 If EZGO suspects that any item may violate the law during inspection, it reserves the right to notify law enforcement, customs, or relevant authorities and provide evidence such as the item itself. 3.3.3 EZGO assumes no responsibility for any losses resulting from inspections or actions taken under these Terms. 3.3.4 If EZGO discovers prohibited items during inspection, it will immediately stop service and has the right to dispose of the items in a manner deemed appropriate.
- Insurance, Delays, and Compensation
4.1 If the value of the shipped items exceeds USD $1000 per item, the Shipper must inform EZGO in advance and purchase insurance. The Shipper is responsible for the cost of such insurance.
4.2 EZGO’s shipping services include international sea or air transport. To protect the integrity of the shipped items, the Shipper must ensure that the supplier packages the goods properly. Any damages resulting from improper packaging will be the sole responsibility of the Shipper. Items that are particularly fragile (e.g., furniture, cosmetics, liquids, and glass) will not be compensated by EZGO, even if additional services are selected.
4.3 Compensation Terms:
4.3.1 If the Shipper notices any issues with the goods upon receipt, they must note it on the delivery receipt and take photos or videos during unpacking for claim purposes.
4.3.2 If no reservations are made at the time of receipt, the Shipper is deemed to have accepted the goods in good condition and no compensation claims may be made.
4.3.3 If the loss or damage is attributed to EZGO, compensation will be based on the declared value or USD $10 per pound, whichever is lower, up to a maximum of USD $100 per shipment. 4.3.4 EZGO's liability is limited to direct losses or damages and does not cover any indirect or consequential losses (e.g., lost profits, revenue, or future business).
4.4 Claim Timeframes:
4.4.1 All claims must be submitted in writing within seven days of receipt of the goods, or EZGO will bear no liability.
4.5 Exclusions from Compensation:
4.5.1 No compensation will be provided for losses or damages resulting from natural disasters, including:
- Losses or damage due to severe weather, lightning, earthquakes, floods, or other natural calamities during transport.
- Damage caused by temperature or humidity changes.
4.5.2 Damage occurring during transport without insurance coverage is non-compensable.
4.5.3 EZGO will not handle claims where the Shipper cannot provide evidence that the items were damaged before arriving in Taiwan.
4.5.4 Certain items, including liquids, hazardous materials, and prohibited goods, are excluded from EZGO’s service coverage for compensation:
- Fragile or improperly protected items such as ceramics, glassware, plastics, books, papers, electronics, CDs, DVDs, cosmetics (e.g., eyeshadow palettes, lipsticks), defective items, or scrap products.
- Items improperly packed by the supplier, without adequate protection.
- Items in sealed packaging or those with external packaging damage but intact internal goods.
- Non-boxed or non-sealed items.
4.5.5 No compensation will be provided for damages caused by unforeseeable or force majeure events such as customs issues, transportation delays, or any events outside of EZGO's control.
- International Conventions
5.1 For shipments transported by air to countries other than the country of origin, if the Montreal or Warsaw Conventions apply, they will govern the shipping terms.
5.2 For international road transport, the Convention on the Contract for the International Carriage of Goods by Road (CMR) may apply. These conventions limit EZGO's liability for loss or damage.
- Shipping Charges
6.1 EZGO's shipping charges are based on the actual weight or volumetric weight of the package, whichever is greater. EZGO may reweigh and measure shipments to verify the calculation. The Shipper must pay or reimburse EZGO for all charges incurred for the shipment, including duties and taxes advanced on behalf of the Shipper or recipient.
6.2 No refunds will be issued for shipments that cannot be delivered due to customs seizures or hold-ups in the importing or exporting country.
- Force Majeure
7.1 EZGO is not liable for delays or other issues caused by force majeure events. Such events include, but are not limited to:
- Natural disasters: earthquakes, tornadoes, storms, floods, fires, epidemics, fog, snow, or other geological disasters.
- Human-caused events: air accidents, war, government actions, legal changes, riots, strikes, or other regional disputes.
- Uncontrollable factors: disruptions to air or ground transportation systems, communication failures, mechanical breakdowns of transportation equipment, etc.
- Third-party errors: such as customs delays, airline mishaps, airport issues, or government actions resulting in shipping delays, defects, or loss of media data (e.g., photos, videos).
7.2 EZGO will endeavor to work with logistics companies to transport the goods to their destination as quickly as possible under these uncontrollable circumstances. However, EZGO is not obligated to notify you of delays or assume liability for transportation delays in such situations.
- Disclaimer
8.1 EZGO does not guarantee that the website's content will meet the needs of all users, nor does it guarantee the functionality of the website.
8.2 EZGO is not liable for any direct, indirect, incidental, special, or consequential losses resulting from improper use, illegal activities, or hacking.
8.3 EZGO assumes no responsibility for service interruptions or related losses caused by government bans, legal changes, wars, power outages, or other force majeure events.
8.4 EZGO is not liable for loss of goods due to negligence or failure of third-party carriers.
8.5 Any delays or delivery failures caused by the Shipper's failure to accurately complete membership or warehouse receiving information are the responsibility of the Shipper.
8.6 If a package shows as delivered to EZGO's warehouse but was not actually received, please contact us with the correct tracking number and proof of delivery. EZGO will respond within 1-2 business days.
8.7 EZGO is not responsible for losses caused by the Shipper's violation of EZGO, airline, shipping company, or customs regulations (e.g., false declarations, restricted items, or exceeding customs
