EZGO飛凰國際物流使用者條款

託運者使用EZGO (包括使用其服務和內容) 須受以下條款與條款管轄。
台端檢閱或使用本網站，將表示台端同意或代表台端所代表實體 (以下統稱「託運者」或「您」) 同意以下所載之全部條款和條件。

EZGO有權隨時自行決定變更、修改、增加或移除本使用條款任何內容。您應自行負責定期檢查本使用條款是否有變更。
凡在變更公告後繼續使用本網站，即代表您接受並同意此等變更。。
對於取自 EZGO的特別功能、特色、資訊和應用程式，亦可能透過 EZGO 規範額外的使用條款與條件。

報關出口與進口

EZGO得代表託運人執行以下任何活動事宜，以提供其服務予託運人：
（1）填寫任何文件，修改產品或服務代號，及支付相關法律與法規所要求之關稅或稅款。
（2）為關稅及出口控制目的，擔任託運人之運送經紀人，為指定報關行執行清關及通關業務而擔任收件人。
（3）EZGO 以其合理之判斷，依據被授權者之請求，重新將貨物發送至收件人之經紀人或其他地址。

申報及禁運相關

一、託運者應誠實申報託運物品(包括但不限於品名、內容、單價等內容)，如因申報不實所衍生之相關法律責任，概由託運者負完全責任。
如因此造成EZGO受有損失，應由託運者擔賠償之責。為了維護運輸安全之需求，必要時託運者同意EZGO開箱查驗受託運送之物品。

二、禁止託運貨物例示名單如下，詳細說明可參本公司網站公布之禁運用品名單，本公司保留解釋及隨時修改禁止託運貨物名單之權利。
(1) 被IATA（國際航空運輸協會）、ICAO（國際民航組織）、ADR(歐洲公路危險物品貨運規則)、任何相關政府部門或其他有關組織歸類為危險物質、危險品或違禁品
(2) 運送、進出口受包括經由國在內的進出口國、州、地方自治區的法令禁止或限制的物品
(3) 該貨件含有膺、偽造品、動物、金塊、貨幣、稅務標籤、無記名可轉讓票據、貴金屬與寶石、武器或其模仿品、武器零件與軍火、屍體、色情書刊及非法麻醉葯／毒品、活的動物、植物等
(4) 該貨件包裝不完整或不適當者
(5) 該貨件包含之任何其他項目，經EZGO判定無法安全或合法地運送時

三、EZGO 保留判定是否承攬所託貨物之權利
EZGO有開封檢查商品內容的權利，但是EZGO並沒有檢驗商品的義務，同時檢驗的結果也不對商品質量、有無瑕疵、真贗品做出保證，不保證商品不違反發出地、經由地、目的地所頒布的相關法令。
EZGO在進行檢驗時，懷疑有違反法律法規可能性的商品時，EZGO可以採取通報警察、海關及相關執法部門，提交商品等措施。若檢驗商品及採取本條規定的處理辦法造成損失時，EZGO不承擔任何責任。
EZGO開封檢查商品，一旦發現禁止運送之貨物，將立即停止服務，並可以馬上棄置或以其他方法處置。

託運與無法託運

貨物不能託運至郵政信箱或郵遞區號，而將被運至由託運人所提供之收件人地址（如是郵件服務，該地址將被視為郵遞服務最先收件者之收件人地址），但不一定須交由收件人本人收執；託運地址若有集中收件區者，貨物將被託運至該區。若貨物被視為不被接受、或因報關目的而低估貨價、或無法合理地辨別或找到收件人、或收件人拒絕收件或支付運費或關稅者，EZGO應儘力將貨物退還託運人，費用由託運人負擔，否則貨物得由EZGO放棄、處分或出售，而不必對託運人或任何其他人負任何責任，該處分所得用來抵扣服務費與有關之管理費，如仍有餘額時將退還託運人

服務責任

由於EZGO未與銷售公司或任何購物網站達成商品的買賣關係，故EZGO不承擔一切與商品相關的瑕疵、侵害知識產權等責任。如會員有證據證明貨物遺失、破損是由EZGO所負責之倉儲及運輸期間所發生，則不受本條款限制。除此之外的一切貨物少發、漏發或品質問題，包括因貨物本身瑕疵造成的遺失、破損，EZGO不承擔任何責任。同時EZGO未與任何運輸公司簽署運輸合約，所以在到達EZGO倉庫前之一切運輸事故，造成未送達、延誤、破損及其他與運輸有關的問題而導致損失，EZGO不承擔任何責任。為確保在爭議管理、退款、訂單取消以及客戶服務方面提供充足的營運支援，EZGO應基於使用者條款負起提供相關內容的責任。

商品價值保險、逾期及賠償相關

(1)若託運物之單價超過$1000美元，託運者應事先告知EZGO，並應自行投保貨物保險，貨物保險之保險費用由託運者自行承擔。

(2) EZGO受託代辦之運送服務為國際海運或空運，為維護運送物之安全，原箱出貨商品託運者就其所託運之物品應自行要求供貨商妥善包裝，
以避免於運送過程中發生毀損、滅失及其他損害。因貨物包裝不固所導致之毀損、滅失，應由託運者自行承擔貨損相關責任。
家具類、美妝品、液體及易碎品部分等極度易損壞物品，若填寫運單時有勾選加值服務操作，運送過程若不幸損壞，應由託運者自行承擔貨損相關責任，EZGO一律不予賠償。

(3)賠償規定：
託運者受領託運物品時如發現貨物有異狀，應於託運憑單或簽收單據簽註保留意見，並於開拆貨物時錄影及拍照存證，作為求償之依據。
如托運者未簽註保留意見，視為託運者受領之貨物完好無缺，不得提出求償。
若託運物品之毀損、滅失係可歸責於EZGO時，EZGO所負之賠償責任，按託運者填寫之物品價值或實重每磅10美元計算，
二者取其較低者為賠償標準，又每一運送提單（CWB）最高賠償金額為100美元。
EZGO之責任完全只限定於直接損失、損害，不包括所有其他類型之損失或損害（如失去的利潤、收入、利益及未來生意等）

(4) 索賠期限:
所有索賠案應從EZGO接受貨物日起七天內以書面向EZGO提出，否則EZGO將不負任何責任。

若託運物品係因以下為原因導致毀損、滅失者，EZGO免負賠償責任：
商品包裝因碰撞造成損害。
(a)因不可抗力因素（如戰爭、天然災害、交通事故等）發生，非EZGO所能控制者。
(b)因出口國或進口國之政府機關之管制措施（如查驗貨、消磁、扣留、沒入等）而致者。
(c)託運物品係屬瑕疪品者（如廢品、送修貨品等）或因託運物品本身性質所導致損失。
(d) 由託運人或其代表人所提供之所有資料是完整與正確的
其他依法律應予免責之事由。

(5)國際公約
貨物如係以空運運送至出發國以外國家為終點站或停留站時，如適用蒙特利公約、或華沙公約，應依其規定辦理。
如係國際公路運輸，則得適用國際公路貨運契約公約(CMR) 。這些公約均限定EZGO之損失或損害賠償責任。

貨物運費

EZGO之貨物運費是根據實際包裹重量或材積重量二者之間較重者計算之，同時任何貨物得由EZGO重新過磅與測量，以確認該計算值是否正確。
託運人應支付或償還EZGO因其提供服務、或代表託運人或收件人或任何第三者所產生之所有貨物運費、相關附屬之費用、代墊之關稅與稅款，
以及貨物如第2條所載被視為不被接受承運時所產生之所有索賠、損害賠償、罰款及費用。

不可抗力之因素情況

大自然因素，包括地震、龍捲風、風暴、洪水、火災、瘟疫、霧、雪、霜凍天氣或地質災害等；
人力不可抗力，發生空難事故、公敵入侵、政府當局、法律權限、暴動、罷工或其它地區性爭執、民眾騷亂或戰爭帶來的危險、
或由非本網站所能控制事項所致的全國性或區域性空中或地面交通系統中斷或通訊系統干擾或故障，運輸工具或機器的機械故障等；
任何由海關，航空公司，機場或政府當局產生的疏失，如海關退運、航班延誤、貨物瑕疵，內容物不完整、磁帶、文件或其它存儲媒體中數據的消除、或曝光底片中照相影像或音帶地消除；
現EZGO無法控制的情況，EZGO仍會盡力地協調物流公司盡快運送至目的地，但我們沒有義務在出現此類情況時向您發出通知；
EZGO不對運輸延誤承擔責任的情況，如EZGO按照其正常運送標準盡力協調派送貨物，但這些標準並不屬於承諾，也不構成服務協議的組成部分。

服務中止

發生以下情況時，EZGO可以暫時中斷或停止本服務的部分或全部內容，不需另行通知。而终止的範圍可包括依據用戶的電話號碼，電郵地址或 IP 地址。
使用EZGO託運服務，代表您同意EZGO將不會就包括但不限於因客戶方原因所引起或造成的損毀、延遲送達、誤送、未送達、遺失而賠償責任。
亦不採取任何運費調整、退款或任何補償行為。對於任何形式的賠償，EZGO將「不承擔任何間接、附帶、特殊或衍生的損失（包括但不限於收入、利潤、市場或機會的損失）
所產生的賠償責任。

以下情況，EZGO不予理賠：

(1)客戶方或第三方的疏忽-違反條款和條件
(2)客戶方提供了錯誤的註冊或聯繫信息，同時無法通過這些信息確認服務或運單造成貨物被銷毀、放棄或做其它處理等
(3)客戶方提供錯誤的貨物追蹤編號，或託運貨物本身沒有貨物編號以致無法追查物流情況
(4)託運貨物中含違禁品
(5)遵循客戶方或其他寄、收件人的口頭或書面送件指示行為導致
(6)包裹在送達時無破損且基本完整、收件人未提出異議並發出書面破損記錄，寄件人包裝並封口的貨物內發生遺失或損毀
(7)沒有及時確認關稅及稅金支付所致的延誤
(8)客戶方提供錯誤的收貨標識、錯誤的預報信息，無入庫記錄，或網站錯發，漏發等造成的損失
(9)客戶方提供錯誤、不完整、不正確或遺漏的地址信息，無法聯繫收件人，造成的重複配送所產生的費用及相關的後果

免責聲明

(1)本公司對網站內容不提供任何擔保，本網站提供之功能不保證一定能滿足會員的特定要求。
(2)本公司及網站對任何直接、間接、偶然或特殊及連帶的損失不負任何責任，這些損失可能來自於不正當、非法地使用本系統或遭受駭客攻擊。
(3)對於因政府禁令、現行生效的適用法律或法規的變更、動亂、戰爭、停電、通訊線路中斷等不可抗力事由、他人蓄意破壞，而造成的服務中斷等一切相關損失不承擔任何責任。
(4)因承運人不履行責任或疏忽而導致貨物發生損失
(5)由於客戶下單時，包裹上未正確填寫會員號碼和倉庫收貨信息，導致包裹延誤派送, 入錯庫，甚至未能送達倉庫等情況，責任由客戶方承擔。
(6)對於當地國或地區境內快遞顯示包裹在有效時間已送達倉庫地址，但核實並未沒收到此包裹，請與我們聯絡並提供正確的貨物追蹤編號（Tracking Number）及簽收證明，我們會在核實後 1 至 2 個工作天內回覆。但EZGO飛凰國際物流，無法控制的情況，仍會盡力地協調物流公司盡快運送至目的地，但我們沒有義務在出現此類情況時向您發出通知。
(7)因客戶違反本公司, 航空和船運公司及海關相關規定和條款，如：申報不實、轉運嚴禁入境之商品、物品數量超過海關規定數量等，所導致的貨物遺失、清關延誤、罰款、罰沒及退運等情況，責任由客戶方承擔。

(8)如包裹中含有申報明細中未列明之物品，此物品一旦發生丟失，責任由客戶方承擔。

(9)正常入庫的貨物，如客戶超過當地倉庫規定天數未提交發貨申請，則視為放棄貨物，且可銷毀，本公司不負責繼續保管，或一旦發生丟失及壞損等不良結果，責任均由客戶承擔。
(10) 如客戶並未對於入庫包裹申請驗貨及核對清點等服務，本公司不承擔可能由於發貨方少發/錯發以及貨物本身具有瑕疵及缺陷而造成的損失。客戶收到貨物後如有貨品,貨量等與實際訂單不符的情況，損失應由客戶方承擔或向發貨方求償。
(11)到貨後一律以我司作業規則為準，集運合併方式我司有最終決定權。若要求保留原包裝箱，理貨後若有增加收費重量由會員承擔，不能取消或要求重新包裝。

(12)不可抗力（這類事件包括但不限於雨季和沿海等地台風和炎熱天氣影響，地震、颱風、洪水、火災、戰爭、罷工、暴動、政府行為、法律政策規定或其適用的變化，或者其它任何無法預見、避免或者控制的事件）等原因造成貨物運輸延期或終止，或途中與機場和碼頭海關置放等待時候發生打濕、融化、變形、凍結和甚至部分損壞等情況，本公司無須為此承擔賠償責任。國內快遞部分無法申請理賠，客戶需請做好包裹防水防雨措施。

(13) 品名、品項無確實申報，未依照規定填寫運單，線路選擇不符合規定本公司將不承擔任何賠償責任。

(14)  當客戶寄送貨品由海關查驗開箱並被要求重新辦理申報事宜，客戶需與本公司簽署《代理報關委托書》。簽署委托書代表客戶同意，完全配合本公司一切代辦報關所需的規範流程，遵守海關相應法令, 法規, 條款等。客戶方負責支付額外產生報關清關費用，以及產生的滯報金、滯納金和海關等執法單位依法處以的各種罰款。如客戶拒絕與本公司簽署任何必須的協議文件，本公司有權立即對客戶賬號做出以下處理：凍結關閉客戶賬號，終止提供任何服務及貨物相關資訊等，且無需要承擔一切後續責任。
(15)國際包裹自交寄之次日起算30日，倉庫代收包裹自入庫之次日起算90日。逾期得不予追蹤查詢，且不負補償之責。

託運人之保證與賠償

託運人因不遵守任何有關法律或法規，以及違反以下保證與表示時，託運人應賠償EZGO並使EZGO免受任何損失或損害：

(1)由託運人或其代表人所提供之所有資料是完整與正確的。

(2)貨物是由託運人員工在安全的前提下所準備的。

(3)託運人僱用可靠的員工來準備貨物。

(4)在準備、儲存與運送至EZGO當中，託運人防止貨物受到未經許可之干擾。

(5)貨物業經適當地標示、載明地址及包裝，以確保在一般處理狀況下能安全的運送。

(6)符合所有相關海關、進口、出口與其他法律與法規規定。

(7)提單業經託運人之被授權代表人簽署，本條件與條款對託運人即具有約束力與強制力。
 

運送貨物路線

託運人同意所有運送貨物路線與改變運送路線，包括貨物可經由中途站轉送，悉由EZGO自行決定。

準據法及管轄法院

為了EZGO之利益，因本條件與條款所引起之任何爭議，應交付貨物運送起始國之非專屬管轄法院裁決，並以該國法律為準據法，除相關法律另有規定者外，託運人應無條件接受該管轄。

可分割性

任何條款之無效性或不具強制性，應不影響本條件與條款之任何其他部分。
 

THE FOLLOWING TERMS AND CONDITIONS GOVERN YOUR USE OF EXGOEX.COM. YOUR VIEWING OR USE OF THIS SITE WILL CONSTITUTE YOUR AGREEMENT, ON BEHALF OF YOURSELF AND THE ENTITY YOU REPRESENT (COLLECTIVELY "YOU" OR "YOUR"), TO ALL OF THE TERMS AND CONDITIONS PROVIDED BELOW. MAY MAKE FUTURE CHANGES OR MODIFICATIONS TO SUCH TERMS AND CONDITIONS AT ANY TIME WITHOUT NOTICE, AND YOUR SUBSEQUENT VIEWING OR USE OF EXGOEX.COM WILL CONSTITUTE YOUR AGREEMENT TO THE CHANGES AND MODIFICATIONS. THERE MAY BE ADDITIONAL TERMS AND CONDITIONS PROVIDED THROUGHOUT EXGOEX.COM GOVERNING YOUR USE OF PARTICULAR FUNCTIONS, FEATURES, INFORMATION AND APPLICATIONS AVAILABLE THROUGH EXGOEX.COM.

Use of EXGOEX.COM

EXGOEX.COM is provided solely for the use of current and potential EZGO INTERNATOINAL INC. customers to interact with EZGO INTERNATOINAL INC. and may not be used by any other person or entity, or for any other purpose. Specifically, all shipping, tracking, rating, receiving invoices, remitting payments, identifying and preparing international documents, estimating duties and taxes, and other information and services may only be used by current and potential EZGO INTERNATOINAL INC. customers for their own shipments. Use of EXGOEX.COM to provide information to or prepare shipments by or for the benefit of third party shippers is expressly prohibited. The use of automated dial-in or inquiry devices to obtain information through EXGOEX.COM is strictly prohibited. EZGO INTERNATOINAL INC. does not accept ideas, concepts, or techniques for new services or products through EXGOEX.COM. If such information is received, it will not be considered confidential and EZGO INTERNATOINAL INC. will be deemed free to use, communicate and exploit such information in any manner it chooses.

EXGOEX.COM Login Registration

You may choose to register with EXGOEX.COM to access interactive features. By registering on EXGOEX.COM, You agree to provide accurate and current information as prompted by the EXGOEX.COM Registration page and maintain Your online profile information to keep it accurate and current. Your email address will serve as your EXGOEX.COM login identification ("ID") and You will be asked to create a password to login your account. You are responsible for all activities that occur under Your ID and password. You agree to immediately notify EZGO INTERNATOINAL INC. of any unauthorized use of Your EXGOEX.COM identity.

Changes to EXGOEX.COM

EXGOEX.COM may add, delete, or change its content and functionality at any time without notice.

Termination of Use

EZGO INTERNATOINAL INC. may discontinue, suspend or modify EXGOEX.COM at any time without notice, and EZGO INTERNATOINAL INC. may block, terminate or suspend Your and any user's access to EXGOEX.COM at any time for any reason in its sole discretion, even if access continues to be allowed to other users.

Ownership

EXGOEX.COM and its content are protected by United States and international copyright, trademark and other laws. Specifically, EZGO INTERNATOINAL INC. does not convey to anyone, through allowing access to EXGOEX.COM, any ownership rights in EXGOEX.COM or in any content appearing on or made available through EXGOEX.COM. Customer may not copy, modify, translate, transmit, distribute, adapt, reproduce, decompile, reverse engineer or disassemble any part of EXGOEX.COM or its content.

Disclaimer of Warranty

EXGOEX.COM AND ITS CONTENT ARE PROVIDED "AS IS". EZGO INTERNATOINAL INC. AND ITS LICENSORS DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, REGARDING ANY SUCH CONTENT AND YOUR ABILIITY OR INABILITY TO USE EXGOEX.COM AND ITS CONTENT. EZGO INTERNATOINAL INC. EXPRESSLY DISCLAIMS AND EXCLUDES ALL WARRANTIES REGARDING EXGOEX.COM AND THE FUNCTIONING OF THE INTERNET WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MEIMEIGLOBAL DOES NOT WARRANT THAT EXGOEX.COM WILL MEET ALL OF CUSTOMER'S REQUIREMENTS OR THAT ITS OPERATIONS WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ANY DEFECT WITHIN EXGOEX.COM WILL BE CORRECTED. FURTHERMORE, EZGO INTERNATOINAL INC. DOES NOT WARRANT NOR MAKE ANY REPRESENTATION REGARDING THE RESULTS OF CUSTOMER'S USE OF EXGOEX.COM IN TERMS OF CAPABILITY, CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION, REPRESENTATION OR ADVICE GIVEN BY EZGO INTERNATOINAL INC. OR AN AUTHORIZED REPRESENTATIVE OF EZGO INTERNATOINAL INC. SHALL CREATE A WARRANTY.

Limitation of Liability

USE OF EXGOEX.COM AND ITS CONTENT IS AT YOUR SOLE RISK. EZGO INTERNATOINAL INC. WILL IN NO EVENT BE LIABLE TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES UNDER ANY THEORY OF LAW FOR ANY ERRORS IN OR THE USE OF OR INABILITY TO USE EXGOEX.COM AND ITS CONTENT INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, BUSINESS, DATA, OR DAMAGE TO ANY COMPUTER SYSTEMS, EVEN IF YOU HAVE ADVISED EZGO INTERNATOINAL INC. OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnity

You agree to defend, indemnify and hold harmless EZGO INTERNATOINAL INC. and its respective officers, directors, employees, agents and representatives from any and all claims arising out of Your breach of any of these terms and conditions, and any of Your activities conducted in connection with EXGOEX.COM.

Links to other web sites

There may be links on the EXGOEX.COM site that allow You to visit the sites of third parties. Neither these sites nor the companies to whom they belong are controlled by EZGO INTERNATOINAL INC.. EZGO INTERNATOINAL INC. makes no representations concerning the information provided or made available on such sites nor the quality or acceptability of the products or services offered by any persons or entities referenced in any such sites. EZGO INTERNATOINAL INC. makes no representations regarding the correctness, performance or quality of any software found at any such sites. You should research and assess the risks which may be involved in accessing and using any software on the Internet before using it.

Export

You assume all responsibility for compliance with all laws and regulations of the United States and any other country from which You may access EXGOEX.COM regarding access, use, export, re-export and import of any content appearing on or available through EXGOEX.COM. You acknowledge and agree that You will not export or import any content to any country to which export or import is restricted under United States law, that You are not a national of any such country, You are not a Denied Party listed on the U.S. Denied Persons List, You are not a Special Designated National on the U.S. Treasury Department's list of Specially Designated Nationals, and that the content will not be used in the design, development or production of nuclear, chemical or biological weapons.

Controlling Law and Severability

This Agreement and Your use of EXGOEX.COM is governed by and construed in accordance with the laws of the United States and the State of California, excluding its conflict of laws provisions. If for any reason a court of competent jurisdiction finds any provision of this Agreement, or a portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible. Any cause of action with respect to EXGOEX.COM or this Agreement must be instituted within one year after the claim or cause of action has risen or be barred and must be brought in a court of competent jurisdiction within the state of California. This Agreement may not be changed or modified without the written consent of EZGO INTERNATOINAL INC..

Terms of Carriage

Customer agrees that international carriage by EZGO INTERNATOINAL INC. or any shipments tendered to EZGO INTERNATOINAL INC. using EXGOEX.COM shall be in accordance with the terms, conditions and limitations of liability set out on the NONNEGOTIABLE Air Waybill, Label, Manifest, or Pick-Up Record (collectively "Shipping Documentation") and as appropriate any transportation agreement between Customer and EZGO INTERNATOINAL INC. covering such shipment and in any applicable tariff, Service Guide or Standard Conditions of Carriage, copies of which are available upon request, and which are incorporated into this Agreement by reference. If there is a conflict between the Shipping Documentation and any such document then in effect or this Agreement, the transportation agreement, tariff, Service Guide, Standard Conditions of Carriage, or this Agreement will control, in that order of priority.

In the event Customer uses EXGOEX.COM to process shipments tendered to EZGO INTERNATOINAL INC. for delivery to locations outside the United States or country of shipment origin, Customer will, at Customer's sole expense, assure that the terms and conditions of international carriage supplied by EZGO INTERNATOINAL INC. from time to time (and which may be amended or modified from time to time at EZGO INTERNATOINAL INC.'s sole discretion) are placed on the Shipping Documentation as may be instructed by EZGO INTERNATOINAL INC., for all such international shipments. Customer will defend, indemnify and hold harmless EZGO INTERNATOINAL INC., its officers, directors, employees and agents from and against any and all losses, damages, claims and other items of cost and expense arising out of Customer's failure to apply the international carriage terms to the Shipping Documentation for such international shipments, including without limitation claims from the recipient of any shipment, and Customer's failure to follow EZGO INTERNATOINAL INC.'s instructions in regard to the placement of the terms on the Shipping Documentation for such international shipments.

Customer acknowledges that if EXGOEX.COM is used to process shipments to locations outside the United States or country of shipment origin, Customer must enter the name of the person completing the Shipping Documentation to print in lieu of its manual signature on the Shipping Documentation, as applicable, for all shipments tendered by Customer to EZGO INTERNATOINAL INC. using EXGOEX.COM. Customer further acknowledges that such printed name shall be sufficient to constitute the Customer's signature, and Customer's acceptance of EZGO INTERNATOINAL INC.'s terms and conditions of carriage contained in the applicable transportation agreement, tariff, Service Guide, Standard Conditions, or Shipping Documentation, under which the shipment is accepted by EZGO INTERNATOINAL INC., or its independent contractor.

Unless otherwise indicated, the shipper's address indicated on the face of any Shipping Documentation is the place of execution and the place of departure and the recipient's address listed on the face of the Shipping Documentation is the place of destination. Unless otherwise indicated on the face of the Shipping Documentation the first carrier of all shipments is EZGO INTERNATOINAL INC.., 466 W. Arrow Hwy Suite M.San Dimas CA 91733

Shipping Information and Database

Subject to the terms listed here, addresses and other shipping information you entered through using EXGOEX.COM will remain in EZGO INTERNATOINAL INC.'s database as long as You remain a user of EXGOEX.COM. If You have any concerns, please email EZGO INTERNATOINAL INC. at CS@EXGOEX.COM. You should maintain a back-up copy of Your shipping information as EZGO INTERNATOINAL INC. will not be responsible for the loss of data stored in its database.

Rate Quotes and Charges

The rate quotes provided by EXGOEX.COM may be different from the actual charges for Your shipment. Differences may occur based on the actual weight, dimensions, and whether the final destination is considered a "remote area" at the time of shipment. Package weight and dimensions are solely determined by the Carrier, not by the values printed on the shipping labels. In case the Carrier determines that the weight and/or dimensions are higher than the values You entered on EXGOEX.COM, EZGO INTERNATOINAL INC. reserves the right to charge Your credit card to cover the full amount of the differences based on the rates published on EXGOEX.COM for the date of the actual shipment.

Delivery of Shipping Documents

In most case Your Shipping Documentation will be available on EXGOEX.COM after Your payment is confirmed. For credit card payments, the approval process generally takes less than a minute and the shipping documents will be ready to download from the website immediately. Your Shipping Documentation will also be sent to your email address at the same time. For other forms of payments (checks, money transfer between bank accounts, Paypal, etc.) Your Shipping Documentation will be processed within one business day after EZGO INTERNATOINAL INC. receives and confirms Your payment.

Changes

All shipments can be modified before the actual Shipping Documentation is generated. If changes are required after the Shipping Documentation is issued, EZGO INTERNATOINAL INC. reserves the right to assess a small service charge to cover the process of voiding the old documents and issuing new ones on Your behalf. No service charge will be applicable if the changes are initiated by EZGO INTERNATOINAL INC. due to its own error or any other reasons.

Refund and Cancellation

All orders and purchases are refundable (minus a small service charge) until Your packages are dropped off with or picked up by the carrier company (selected at EZGO INTERNATOINAL INC.'s sole discretion) and the shipping labels are scanned. Orders can be cancelled at EXGOEX.COM or by contacting EZGO INTERNATOINAL INC.'s customer service department at CS@EXGOEX.COM. Refunds for cancelled orders will be processed within three (3) business days from the time the order cancellation is confirmed by EZGO INTERNATOINAL INC.. EZGO INTERNATOINAL INC.
